Disclaimers, Terms and Conditions.

Our understanding of the complexity of the U.S and Kenyan Ports and Customs Regulations has enabled us to create solutions for today’s competitive landscape, and we believe we are able to provide a service to meet your needs.

 Pickup Process in USA


By sending us your address and confirming your pickup day, accepting our receipt, and handing your shipment to Nai Shipping Solutions, and/or any of its agents, you agree to all our terms and conditions,  current shipping price, and/or the price you were quoted. 

Although great care will be taken when handling your cargo, customer  acknowledges that you have been notified that the box, drum, tote, bag, or any package used to ship your cargo may change shape due to stacking, loading, offloading, weight imbalance in your shipping package, poor packaging, and/or  other factors within the shipping industry.

Pickup Process in Kenya


In order for your item to be released, You or your agent must have a soft or hard copy of the receipt, your name(s) must be on the receipt, and you must have a ID at pickup. Once a notification for pickup has been sent, all customers have two weeks to collect their shipment. There is a $10/day storage charge after 2 weeks which must be paid before goods are released. All cargo not picked up after 30 days will be considered abandoned and Nai Shipping Solutions, and/or any of its agents, will dispose the goods in the way we feel best fit. 

If there is any issue(s) with your shipment, you should notify us before you leave our premises. Once good have left our premises, we will not accept any claims.

Payment Options


We offer a variety of payment options; All major Credit Cards at a fee, Cashapp, Zelle, check, Cash and Mpesa. Please note that this is a prepaid service and all payments are made at pickup or immediately after you have been invoices with a dollar amount. This will help to facilitate a smooth shipment and to avoid the collection process. We do not ship cargo not paid for. We reserve the right to charge late fees of up to to $100 per invoice that is paid 21 days after cargo ships. 

Transit Time


We ensure transit times that we have promised are met. All Sea Cargo takes approximately  3 months from the time it sails from the U.S port until your agent receives it in Kenya. Although this is true with most shipments, other factors like Weather, Security, Port delays, ship route, pandemics, epidemics, act of war and insecurity, new government regulations or other problems that may be out of our control can affect this timeline. We are not financially responsible for any damages due to such delays. However, be assured we will make every effort to have it there on time and in Good shape.

Disclaimer 


In accordance with US Customs, TSA Regulations, and the Government of Kenya, this Notice authorizes Nai Shipping Solutions LLC and its Agents to screen all Cargo tendered by the shipper. Although great care is taken during such screening and no gross negligence in handling of any cargo, Nai Shipping Solutions LLC is not responsible for Loss, Damage or Delays due to such a screening. 

Our liability cap is $200 per customer, per shipment. Insurance should be purchased for items you feel necessary. By Using our service you agree to all terms, conditions and our liabilities outlined on this platform and other platforms that we use to communicate with you, and accepting a payment receipt/invoice and/or when we have your cargo in our possession for shipment. 

U.S. Customs/KEBS/KRA Inspections and other Liabilities


US Government and its agents, and Kenya government and its agents, will sometimes stop a cargo for inspection/screening. We are not involved in such an inspection, and not even allowed in some of the inspection facilities. It is rear items get damaged or lost during such an inspection but this notice serves as a disclaimer that we are not responsible for any loss and delays that happen due to this inspection. 

Other Disclaimer
We are not liable for financial consequence if you have Omissions, Improper marking, and improper packaging of your items- always declare each item you ship on your packing list . We are not liable due to total Loss or damage caused by natural disasters or other events out of our control including but not limited to war, piracy, public enemies, act of public authority while the shipment is in transit.

Required Documents - Prohibited Items - Recommendations/Disclaimers.


Packages without a packing list will not be shipped. Customer is responsible to fully declare the content of his/her cargo. See list of prohibited items below. Fees and Fines due to omissions, intentional or not,  will be the sole responsibility of the customer. Shipments will not be released and or will not be cleared/will be left at the port to be disposed if fees are not paid and paid on time. We have a right to inspect all cargo and/or refuse to offer shipping service even after picking up your cargo - customer is responsible for the cost to ship back the cargo.

  • We no longer accept any glass furniture and if we pickup any glass furniture we are not liable if glass breaks.
  • Mattresses must be wrapped in a strong heavy duty mattress cover - we recommend using cloth mattress covers - we are not responsible if mattress gets dirty due to the cover tearing and dirt on mattress.
  • Fridges, other non-glass furniture, large need furniture blankets to further protect your cargo. Although we handle your cargo the proper way, other government agencies that handle your cargo during inspection don't handle your cargo the same way - the extra padding protects your cargo.
  • Note that cargo looses shape while on transit - boxes loose shape, bags compress and look smaller, or as if something was removed. This happens due to the handling of cargo, stacking, inspections, loading, off loading, and other factors in the shipping process.



Going forward we are strictly enforcing these rules:


1. NO FOOD, DRINKS, OR MEDICAL EQUIPMENT. (This includes cooking oil)

Medical equipment meaning anything that will go into a human body/anything that can carry contaminants. Items like wheelchairs, blood pressure monitors, crutches, walkers, commodes - these items are ok to ship.


2.BAGS ARE FOR CLOTHES, SHOES, AND ANYTHING MADE OF FABRIC. We will not accept bags with anything else. If an item other than the above mentioned is in the bag and is damaged, WE ARE NOT RESPONSIBLE.


3. OVERFILLED BAGS WILL TEAR. We will not accept bags that are overfilled. Leave room in the bag for items to spread when we are stacking.


4. IF TWO PEOPLE CANNOT LIFT YOUR CARGO - ITS TOO HEAVY. We don't charge for weight but cargo cannot be overweight. Please help us handle your cargo properly by keeping the weight manageable.


5. PACKING LIST REQUIRED AT PICKUP. This helps us declare what is being shipped - omission, intentional or not, and and fines related to it will be paid by the customer.
